This Privacy Policy describes the policies and procedures of 1 Finance Private Limited ("we," "our," or "us") regarding the collection, use, and disclosure of your information when you use the PlanMyTax (“PMT”), accessible via planmytax.ai and related digital applications (collectively, the "Platform"), and explains your privacy rights and how the law protects you. This Privacy Policy shall be read in conjunction with and forms an integral part of the Terms of Use governing your access to and use of the Platform.

By registering on the Platform and providing your consent through the consent mechanism made available, you agree to the collection and use of information in accordance with this Privacy Policy. This Policy is published in accordance with the Information Technology Act, 2000, the rules framed thereunder, and the Digital Personal Data Protection Act, 2023 and its related rules.

We use your personal data to provide and improve the services offered through the Platform.

  • Account: A unique account created for you to access our service or parts of our service.
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to 1 Finance Private Limited.
  • Platform: Refers to the Plan my Tax website and mobile application, accessible from planmytax.ai and related mobile apps.
  • Service: Refers to all the services provided by us through the Platform.
  • Usage Data: Refers to data collected automatically, either generated by the use of the service or from the service infrastructure itself (for example, the duration of a page visit).
  • You: Means the person accessing or using the service. Under the DPDP Act, you are referred to as the Data Principal.

2. Status Under Applicable Law

For the purposes of the Digital Personal Data Protection Act, 2023 (“DPDP Act”), 1 Finance Private Limited act as a Data Fiduciary in respect of the personal data collected through the Platform. Users whose personal data is processed are Data Principals.

3. Information we collect about you

In line with the principle of data minimisation, we collect and process only such personal data as is necessary for the specific purposes described in this Privacy Policy. This may include:

3.1 Information You Provide to Us:

  • Account Registration: When you register, we collect personal identification details such as your name, address, contact information, email address, phone number, date of birth, gender, and password.
  • Tax-Related Information: To provide tax filing and related services, we collect your Permanent Account Number (PAN), Aadhaar number, where voluntarily provided and processed strictly in accordance with applicable law, bank account details, MICR Code, income and deductions data, expense data, asset and liability particulars, vouchers, bank statements, Form 16, Form 26AS, tax payment challans, tax profit and loss statements, crypto trade statements, Director Identification Number (DIN), and any other information necessary for preparing and filing your tax return.
  • Communications: If you contact us, we may retain records of correspondence, emails, or details of conversations through Whatsapp or otherwise.
  • Newsletter: If you subscribe, we collect your email address.

3.2 Information We Collect Automatically:

  • Usage Data: When you visit the Platform, we collect details of your visits, including your Internet Protocol (IP) address, domain name, browser type and version, operating system, traffic data, location data, web logs, and other communication data.
  • Cookies and Tracking Technologies: We use cookies and similar technologies to track activity on our service and hold certain information to improve and analyse our service. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent.

3.3 Information from Third Parties:

With your authorization, we may retrieve your information from third-party providers, to automate data entry and provide our services more efficiently.

4. Lawful Basis of Processing and how we use your Information

  • To prevent online fraud, cybercrime, and any other prohibited or illegal activity.
  • To recover any outstanding payments due to us.

5.1 Within the 1 Finance Group:

  • Tax Departments: To access your tax information and facilitate the electronic filing of your returns.

We may retain your personal information in order to maintain backup records, enable you to access your previously submitted tax information when you return to the Platform, and assist you with filing future income tax returns. Retaining such information allows us to provide continuity of services and facilitate faster processing in subsequent years.

Where you request deletion of your personal data, we will take reasonable steps to delete or anonymise such data, unless retention is required under applicable law or is necessary for the resolution of disputes or enforcement of our legal rights.

8. Your Rights as a Data Principal

You have certain rights regarding the personal information we hold about you, in accordance with applicable law. In addition to the rights already described in this Privacy Policy, Data Principals have the right to:

  • Access: Obtain a summary of personal data being processed. You can request a copy by visiting the "My Dashboard" section or by contacting us.
  • Correction: Request correction of any inaccurate or incomplete personal data.
  • Erasure: Request erasure of personal data. You may choose to delete your account at any time.

13. Conflict Clause
